NASCAR 2015 News: Kurt Busch Not Facing Criminal Charges
Kurt Busch will not face criminal charges in Delaware. Even though an order of protection was issued for his ex girlfriend and a Commissioner ruled that is was highly likely that Busch had committed an act of family violence the State will not bring charges against him. In a statement reported by Jayski.com the Delaware Attorney General said, "After a thorough consideration of all of the available information about the case, it is determined that the admissible evidence and available witnesses would likely be insufficient to meet the burden of establishing beyond a reasonable doubt that Mr. Busch committed a crime during the Sept. 26 incident."
After the initial finding by Family Court of Delaware Busch was indefinitely suspended by NASCAR. Busch accepted that punishment and entered into a program with NASCAR to earn his way back into the racing series. With no formal criminal charges being brought NASCAR remains committed to having Busch complete that process for him to be reinstated. In a statement the racing series said, "NASCAR is aware of the Delaware Department of Justice announcement today regarding driver Kurt Busch. As we disclosed Monday, he has accepted the terms and conditions of a reinstatement program and is actively participating in the program. Kurt Busch's eligibility for reinstatement will continue to be governed by that program and the NASCAR Rule Book."
Busch released a statement of his own saying, "I am grateful that the prosecutors in Delaware listened, carefully considered the evidence, and after a thorough investigation decided to not file criminal charges against me. I wish to thank my family, friends, fans, and race team who stood by me throughout this nightmare with their unwavering support. Thanks also goes to my legal team for making sure that the truth got out and was fully provided to the prosecutors. As I have said from the beginning, I did not commit domestic abuse. I look forward to being back in racing as soon as possible and moving on with my life."
Given the seriousness of the chargers and in the aftermath of the Ray Rice incident in the NFL NASCAR has no choice but to take a hard line with Busch. There is no timetable as of yet for Busch's return to his #41 Stewart-Haas Racing team.
