However, during "The Star Spangled Banner," McKelvey caused a stir when he did not participate in the in the national anthem and opted to speak on his cell phone during the moment of silence.

The surrounding Jets fans were sure to let McKelVey know of their disapproval by taunting and cursing at the man.

Feeling threatened and that there would soon be an altercation, McKelvey pulled out a stun gun, and managed to taze three people before he was apprehended.

In a statement released by McKelvey, he says he is not a "criminal" and he did "what I had to do" to protect himself in the situation claiming self defense as the reason for his actions.

McKelvey's son, Charlamagne Tha God, a popular radio deejay on Power 105.1, came to his father's defense and told newspapers his father is a Jehovah Witness. He claimed that it was against his religious practice to stand for the national anthem and he was doing what he had a right to do.

McKelvey was arrested on the scene and taken to a New Jersey prison. He was released Monday night on $22,500 bail and was charged with three counts of aggravated assault and illegal possession of a stun gun.
