Greg Kelly, Fox News Anchor, Cleared of Rape Charges
Greg Kelly, co-host of Fox News' "Good Day New York," will not face sexual assault charges regarding the alleged rape of a woman during a one night tryst, prosecutors announced Tuesday.
The woman alleged that Kelly, son of New York City's Police Commissioner Ray Kelly, assaulted her after the two had drinks last October.
According to the woman's report, she and Kelly met on the street in lower Manhattan in Oct. 2011. Three days later they met for drinks at Jeremy's Ale House at the South Street Seaport, and then went back to her lower Manhattan law firm, where the rape allegedly occurred. The woman also told investigators that Kelly impregnated her, and she had no choice but to have an abortion.
Kelly had vehemently denied any wrongdoing from the beginning. His attorney, Andrew M. Lankler, told NBC New York at the time of the investigation that his client "strenuously denies any wrongdoing of any kind, and is cooperating fully with the district attorney's investigation."
When the woman reported the claim on Jan. 24, the case was turned over to the district attorney's office to avoid a conflict of interest between Kelly and his father, Police Commissioner Ray Kelly.
According to The Huffington Post, investigators reviewed text messages, telephone records, receipts, and security logs. Both Kelly and the woman, who chose to remain anonymous, were interviewed.
The chief of Manhattan district attorney's office sex crimes unit Martha Bashford sent a letter to Kelly's attorney, Andrew M. Lankler, on Tuesday. According to The Huffington Post, the letter read:
"After reviewing all of the evidence, we have determined that the facts established during our investigation do not fit the definitions of sexual assault crimes under New York criminal law. Therefore, no criminal charges are appropriate."
Kelly, 43, will return to this spot as co-host of Fox 5's "Good Day New York" on Friday, Feb. 10. The marine-turned-TV journalist joined the Fox News Network in 2002 and was a White House correspondent for Fox News from 2005 to 2007.
