Matthew Fox Assault Charges Dropped
A lawsuit against Matthew Fox, who was part of the television series "Lost" for an alleged assault, was dismissed.
The lawsuit stemmed from an incident involving a female charter bus driver and Fox, who claimed he never assaulted the woman for refusing him entry.
Cuyahoga County Common Pleas Judge Deena R. Calabrese dismissed the case after the lawyer for Heather Bormann, 29, withdrew her story that Fox had hit and kicked her after she denied him entrance on her charter bus.
That action caused Fox, 45, to also drop his countersuit against Bormann for defamation, Fox's attorneys, Ian Friedman and Ronald Frey, told Cleveland.com.
"Today's dismissal validates our contention from day one that the original accusations were entirely baseless," Friedman said. "We are all glad that the truth has surfaced, and Ms. Bormann's dismissal of all claims brings this case to an end."
The judge presiding over the case dismissed the case with prejudice, which means that Bormann is prevented from filing another lawsuit against Fox.
J. Norman Stark, who is representing Bormann, said his client thought she could not see the case through to the end and was concerned she might not win.
"I told her Fox's attorneys filed a serious counterclaim," Stark said. "I told her it will be very costly to defend her against their counterclaim. She decided as a single mother with three children that she couldn't afford it.
The disputed incident occurred in August 2011, when Bormann accused Fox of hitting her in the breast and groin after she denied him entry on a chartered party bus.
Bormann stated the she refused to let Fox onto the bus because he was already too intoxicated to board, but when he refused to leave the bus is when Bormann claimed Fox struck her.
"He just kept staring at me with his mouth wide open and not saying anything. I told him, 'You have to leave buddy. You are trespassing on my bus,'" Bormann told TMZ.
"This was my self-defense," Bormann said adding, "this was the only way I could protect myself … from a man beating up on a woman."
