‘Obvious discrimination’: Conservatives decry Supreme Court refusal to block Nev. restrictions on church gatherings

U.S. Senator Ted Cruz of Texas, a former law clerk for U.S. Supreme Court Chief Justice William Rehnquist, expressed his discontent with the decision.

In a post to his official Twitter handle, Cruz argued that current Roberts, by being the decisive vote in favor of denial, had “abandoned his oath.”

“John Roberts has abandoned his oath. But, on the upside, maybe Nevada churches should set up craps tables? Then they could open?” tweeted Cruz on Saturday, getting as of Monday morning over 30,400 likes and 12,300 retweets.

Cruz also included a link to a short dissent written by Supreme Court Justice Neil Gorsuch, who argued that the Nevada restrictions constituted “obvious discrimination against the exercise of religion.”

“The world we inhabit today, with a pandemic upon us, poses unusual challenges. But there is no world in which the Constitution permits Nevada to favor Caesars Palace over Calvary Chapel,” wrote Gorsuch.
