Subpoena for Fox Reporter After Revealing James Holmes' Notebook?

Attorneys for James Holmes, the suspect in the Colorado movie theater shooting, revealed their plans to issue a subpoena for a Fox News reporter. The journalist was the first to disclose that Holmes had sent his psychiatrist a notebook containing graphic descriptions of violent acts after he was arrested.

The announcement of the pending subpoena came during the end of a court hearing on Monday after nine police officials testified to having no involvement in telling Fox reporter Jana Winter about the notebook.

Holmes' lawyers argued that disclosing information regarding the notebook violated a gag order in the case and are pursuing avenues to identify the person responsible for leaking information sensitive to the case.

In the days that followed the shooting, authorities investigated all connections to Holmes. Four days after the shooting, they recovered a package in the mailroom of the University of Colorado, Denver that was reported to contain a notebook.

Winter reported that the notebook contained violent descriptions of possible attacks. That's the reason for Holmes' defense attorneys to suspect that information surrounding the notebook must have come from a person with close knowledge of the investigation.

One of the law enforcement officials called to testify was Aurora Police Sgt. Matt Fyles, who explained that his department and university police had a disagreement over which entity had jurisdiction over the notebook.

Aurora police obtained a warrant shortly after the notebook was found and then seized custody of the notebook, which was then later turned over to the court, according to the Associated Press.

James Holmes is currently the only suspect in the crime and was arrested by police at the scene of the shooting. He currently remains in police custody.
