The Senate confirmed Judge Amy Coney Barrett of the U.S. Court of Appeals for the Seventh Circuit to the U.S. Supreme Court in a vote of 52-48, mere days before the 2020 presidential election.

Trump nominated Barrett to replace the recently deceased Justice Ruth Bader Ginsburg, who was known to be pro-choice yet also had been critical of the specifics of the Roe decision.

During her Senate hearing, Barrett explained that while there are “cases that are so well settled that no political actors and no people seriously push for their overruling,” she did not consider Roe to be one of them.

“[Scholars] across the spectrum say that doesn't mean that Roe should be overruled, but descriptively it does mean that it's not a case that everyone has accepted,” she added.
