Brooke Mueller Custody Battle Could be Settled by Christmas, Source Says

Brooke Mueller is out of rehab and determined to win back custody of twin sons Bob and Max, especially now that Denise Richards, their temporary guardian, no longer wants custody. Ex-boyfriend Charlie Sheen is not happy with the plan and is also fighting to gain custody of the boys.

"Brooke will be awarded custody of the boys by Christmas, as long as she doesn't relapse," a source told Radar Online. "She has been sober for several months. She hasn't had one dirty test. She has done everything that has been asked of her by DCFS, so at this point, there is absolutely no reason for Brooke not to get her boys back."

Richards, who has had custody ever since Mueller was held on a 5150 psychiatric hold after overdosing on crystal meth, decided that she no longer feels she can properly care for the 4-year-old boys. In a letter written to DCFS, Richards claimed that the twins had abused her own children and pets and were becoming uncontrollable and needed professional help.

Sheen does not want Mueller to regain custody but is apparently under a gag order not to talk about the case. If he does, he could go to jail or pay a severe fine. However, he has managed to make his feelings quite clear via a blog post.

"I am beyond their [CPS workers'] timid morality, therefore I am beyond caring [about any potential gag orders]… What my family and I have been forced to deal with in the last 4 years lives outside the pale of any acceptable conduct or decency. I am battling an amorphous enemy that needs to be swiftly disempowered," Sheen wrote.

"These crimes against my children will be exposed. These war criminals will be hanged at dusk to a cheering and jeering crowd, gathered together in love in support of all children who are mercilessly discarded like garbage by CPS," he added.

The twins are adjusting to having Mueller back in their lives after a long absence. Last Friday they had their first supervised overnight visit with their mother.
