Sean Kingston Fighting $5 Million 'Rape' Lawsuit, Trial Date Set

Sean Kingston has reportedly been slapped with a $5 million rape lawsuit, three years after criminal charges were dropped.

Carissa Capeloto, 22, filed a lawsuit against Kingston, 23, alleging that the singer, his bodyguard and a member of his band raped her at a Seattle hotel in July, 2010. She also alleges that the incident occurred while she was "obviously intoxicated [and] incapable of consent," however Kingston has openly denied Capeloto's claims insisting that their sexual encounter was consensual, according to TMZ.com.

Capeloto, who was accompanied by a friend during the night of the incident, was reportedly transported to hospital via ambulance at one point where rape tests were conducted. Police eventually determined that the case was not credible and all charges were dropped.

A trial date was recently set for November and Capeloto, who was 19 at the time, is reportedly seeking $5 million damages, claiming that she suffers from loss of sleep, panic attacks and mood swings as a result of the alleged incident. Kingston reportedly filed legal documents insisting that Capeloto's claims are false.

Capeloto's friend reportedly also had a sexual encounter with a member from Kingston's entourage and while she too underwent rape tests, she has not filed a lawsuit.

In 2012 Kingston was reportedly sued by a Miami landlord who claimed the "Back 2 Life" singer and his mother caused $21,397 in damages to his $25,000-per-month rental property before abruptly leaving and subsequently breaking a rental agreement.

The lawsuit claimed that upon leaving the rental mansion, Kingston and his mother allegedly left broken landscaping lights, sprinkler heads, holes in the wall, and broken railing around the waterfront dock.

As per the alleged rental agreement, the landlord sued for a total of $73,816.85, which included $50,000 for two months rent and damages. The case is believed to be ongoing.
