10 states with abortion referendums in 2024

On April 1, the Florida Supreme Court ruled that a referendum that could establish a right to abortion in the state constitution could appear on the ballot in November.

If approved by voters, Amendment 4 would amend the Florida Constitution to read “No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.” 

Florida law prohibits abortions after six weeks gestation.

Unlike in all the other states that have held abortion-related referendums thus far, Florida requires all ballot measures to receive 60% support from voters in order to pass rather than a simple majority. Polls analyzing public opinion regarding Amendment 4 yield conflicting results when predicting its ability to reach that threshold. 

While an August 2024 poll of 837 voters conducted by the Democratic firm Public Policy Polling showed 61% of Floridians planned to support Amendment 4 and 25% intend to oppose it, other recent polls have revealed lower levels of support for establishing a right to abortion among the public.

An August survey of 1,055 registered voters conducted by Florida Atlantic University and Mainstreet Research from Aug. 10-11 measured support for Amendment 4 at 56% and opposition to it at 21%. 

Another recent poll about Amendment 4, based on responses from 500 likely voters collected by Suffolk University and USA Today from Aug. 7-11, found that just 58.2% of Floridian voters plan to back Amendment 4 while 35.2% intend to oppose it and 5.2% are unsure.
