Lindsay Lohan Deposition Missed Again; Star Goes for Sushi Instead
Lindsay Lohan's deposition in the case brought against her by paparazzo Grigor Balyan has been stayed because she failed to show up to court. This is not the first time Lohan has missed a court appearance, and sources say she could be forced to show in court or face a hefty fine.
The lawsuit, which was filed in Los Angeles, was scheduled to take place yesterday morning, but Lohan never showed up. It was a scenario similar to one that occurred last month, when Lohan arrived for court 45 minutes late after disembarking from a flight. The judge threatened to issue a warrant for Lohan's arrest if she was a no-show, but the star managed to arrive after all.
Now the same situation has happened again, although sources told TMZ that Lohan's attorney tried to explain that she was unable to get in contact with her client but that the judge did not reschedule the deposition. Balyan's lawyers may choose to file papers requesting that the judge issue a summons ordering Lohan to appear in court.
Lohan chose to remain in New York and was spotted walking into Lure Fishbar on Mercer Street just hours after she was supposed to be in court, according to TMZ. It's unknown exactly why Lohan has been avoiding her lawyer and the legal system at all, given her previous experience with strict judges and the courts.
If Lohan continues to refuse to show for depositions, Balyan's lawyers could ask the judge for a ruling without her there. It's likely that Lohan would automatically lose the case and the judge could rule against her, which could cost her a pretty penny.
Balyan has alleged that Lohan hit him in a car accident and left him badly injured. His lawyer told the Los Angeles Superior Court that he was seeking damages over $25,000 for personal injury, property damage, and general negligence.
"Defendants, each of them, so negligently, carelessly, and recklessly operated, maintained, repaired, owned, and controlled their automobile so as to cause an accident which resulted in personal injuries and property damage to Plaintiff," the court documents obtained by Entertainment Weekly stated.
